An actress who claims to have sexually harassed through the owner of Richmond’s luxury gun club, The Preserve Sporting Club and Residences, has been granted permission to file a retaliation charge in her federal lawsuit.

In the most recent exchange of claims and counterclaims involving Alison McDaniel and The Preserve owner Paul Mihailides, U. S. District Court Judge Paul Mihailides has been a key figure in the U. S. District Court for the Preservation of the U. S. District Court for the Preservation of the U. S. District Court of Appeals for the Preservation of the U. S. District Court of Appeals for the Preservation of the U. S. District Court of Appeals for the Preservation of the U. S. District Court ofU. S. William E. Smith this week allowed McDaniel to amend his trial to include an express charge of retaliation.

That incident was named by the defendants in the case (Mihailides, The Preserve, and its holding company) and they filed a report of the incident with police in Dallas, Texas, where McDaniel recently lives.

The incident report said McDaniel, who worked as a contracted spokesperson for The Preserve doing promotional work, “fired” in late 2021 and allegedly committed computer theft and other crimes against The Preserve, Smith explained in his ruling.

The filing of the incident report was enough for a Dallas detective to speak with McDaniel about the theft allegations, which were never filed with the Rhode Island Police Department, McDaniel’s attorney, Mark Gagliardi, said.

Smith said in his ruling, “It is vital to note that the presentation of the case through the defendants is not a trivial affront or minor inconvenience that does not fall within the scope of anti-discrimination laws. “The defendants “invoked the force of a local criminal justice system, several months after the alleged volatile habit, to harass her for having that habit [when filing her complaint]. It’s nothing we need to get rid of. “

McDaniel and Mihailides have been trading public accusations against each other since at least last summer.

In July 2023, McDaniel, who runs her own promotion agency, filed a federal lawsuit against Mihailides and The Preserve, alleging that from her hiring in December 2019 until her departure in February 2022, she was continuously subjected to unwanted sexual comments and advances by Mihailides. .

Mihailides, according to his lawsuit, “subjected her to repeated sexual advances, adding attempts to kiss her on the mouth, requests for sexual favors, including touching, looks with suggestive connotations, and verbal and physical harassment of a sexual nature, which were unwelcome and offensive to McDaniel. “

As an example, McDaniel alleges in his lawsuit that on Oct. 11, 2021, he met with Mihailides “as part of a new attempt to unload a late paycheck. “During that meeting, Mihailides told McDaniel that he was a “good lover” and that if she’s “not so prudish, [her] life can be so much better,” or words to the same effect, repeating to her, “You give a little, you receive a lot. “

Two weeks after McDaniel filed his complaint, Mihailides filed a lawsuit.

He denied all allegations and called McDaniel a disgruntled former contractor who tried to extort $50,000 from The Preserve after he had difficulty recovering a laptop, hard drive and other assets from the preserve.

“After the Boulder Hills Reservation rejected McDaniel’s $50,000 extortion request to recover his hard drive and after McDaniel attempted to sabotage the reservation’s social media sites and effectively thwarted that effort, McDaniel embarked on a public crusade to harass, shame, and threaten. intimidate, defame, and slander Mihailides,” the complaint reads.

Mihailides said this is the first time McDaniel has sued an employer for sexual harassment.

In 2009, while serving as CEO of a restaurant partly owned by artist Justin Timberlake, McDaniel claimed in a lawsuit that he had been “subjected to despicable and discriminatory conduct and a hostile work environment, because of his gender. “

McDaniel alleged that Timberlake and others “allowed themselves and others to view pornography on the Internet on the restaurant’s premises, in [their] presence, and for their undue emotional misery and humiliation. “The matter was resolved.

McDaniel, who starred in “The Hunger Games: Catching Fire” and the soap opera “Guiding Light,” is suing Mihailides and The Preserve for $3. 1 million in damages and lost profits.

Mihailides’ counterclaims include unspecified damages for “conversion, extortion, telephone fraud, computer crime, check tampering, online identity theft, cyberbullying and cyberbullying, defamation, and privacy claims. “

McDaniel for a jury trial.
