After the hearing, Weinstein’s lawyer, Diana Fabi Samson, spoke outside, according to People magazine.
Samson said Weinstein “is eager to go to court and prove his innocence. He is not doing well physically and that has affected his intellectual state. “
At a July 9 hearing, prosecutors told the ruling that an investigation into Weinstein was still ongoing after several accusers moved forward following the overturned rape conviction. Assistant District Attorney Nicole Blumberg explained that while they were investigating, no grand jury was convened. Weinstein’s team claimed that the new investigation was just a delaying tactic used by the prosecution.
However, the Manhattan District Attorney’s Office denied the accusation and stated: “There are no delaying tactics on our part. We are proceeding as temporarily as possible. “

In a 4-3 decision, the court found that the ruling in Weinstein’s trial allowed prosecutors to call as witnesses women who said Weinstein assaulted them, even though their allegations did not particularly relate to the mogul’s allegations. of entertainment.
Weinstein was sentenced to 23 years in prison after being convicted in February 2020 of forcing oral sex on television and film production assistant Mimi Haley in 2006 and third-degree rape of hairdresser Jessica Mann in 2013.

He was acquitted of first-degree rape and two counts of predatory sexual assault following allegations of rape through actress Annabella Sciorra in the 1990s. Weinstein has denied having sex without consent.
Ultimately, the appeals court ruled that the trial deserved to have allowed only witnesses to testify about the sexual assaults underlying the charges against Weinstein. During his trial, several women testified about sexual assaults allegedly committed through Weinstein, but that was not why he was facing charges.
After Weinstein was convicted in New York in 2020, he was extradited to California in July 2021 to face sexual assault allegations made by four women in Los Angeles and Beverly Hills between 2004 and 2013.

Due to the overturned conviction, California requested Weinstein’s extradition so he could begin serving his 16-year sentence. Weinstein’s team opposed the extradition at a hearing on May 9.
“Our biggest fear in all of this is that Mr. Weinstein will be here in New York, so that we can prepare for his trial and that he will receive the medical care that he needs,” Samson told reporters at a press convention after the hearing. “And I was just worried that the trip. . . would have an effect on his fitness issues. “
Then he pointed out: “He has very serious health problems. And I think it should also be noted that since the day of his imprisonment he has been hospitalized. “
Samson also noted that California “is not in a position to extradite Mr. Weinstein because she didn’t do what she had to do. “
Weinstein’s hearing in the case will take place on Aug. 7.
